Social Security Name Change After Divorce
The form is the same free SS-5 everyone uses; the difference is the evidence. Social Security accepts a divorce decree only if it restores your former name — a decree that merely ends the marriage proves nothing about your name.
What SSA accepts
A certified copy of the divorce decree that states your former name is restored, or a court order granting a name change. The document must show both names or be paired with one that does (a marriage certificate linking the maiden name to the married name, if the decree only names the married one). Plus a current photo ID — the old-name license is fine. No fee.
If the decree has no clause
SSA can't act. Either reopen the divorce case for an amended decree (often a short motion) or file a standard name-change petition; see the divorce guide for the two paths. The plan builder stops and tells you this if you answer "no clause".
How to file
Complete the SS-5 (the free packet fills it for the divorce case), then mail it with the certified decree copy and ID to your local office, or bring it in — the office locator is on ssa.gov. Some states allow starting the request in a my Social Security account and finishing by mail. Documents are returned. The card arrives in about two weeks, but the record updates in days, and that's what the DMV checks: wait 24–48 hours before the license visit.

Is the Social Security name change free after divorce?

Will SSA accept my divorce decree?
Only if it restores your former name (or a separate court order does). A decree that just dissolves the marriage isn't evidence of a name change.
Do I need my marriage certificate too?
If the decree names only the married name, bring the marriage certificate so SSA can link the maiden name. Bring both to be safe.
How long until I can go to the DMV?
Wait 24–48 hours after SSA processes the change; the DMV verifies electronically and turns away same-day attempts.
